1. Who these terms are with
Tess (“the Service”) is provided by Tech Direct Support(“we”, “us”), Australia. By creating an account or using the Service you accept these terms. If you are agreeing on behalf of an organisation, you confirm you are authorised to bind it.
2. What the Service is
Tess is a voice and text assistant that manages calendar events, tasks and contacts on your instruction, and can connect to Google Calendar or Microsoft 365 to act on your real calendar.
The Service is in early access. It is offered to selected clients while under active development. Features may change or be withdrawn, and availability is not guaranteed. It should not be used as the sole record of a commitment, and you should keep your own record of anything you cannot afford to lose.
3. Your account
- Keep your credentials confidential; you are responsible for activity under your account.
- Give us accurate account information and keep it current.
- Tell us promptly if you believe your account has been compromised.
- Do not share an account between people.
4. Acceptable use
You agree not to:
- use the Service unlawfully, or to store or transmit unlawful material;
- connect a calendar you are not authorised to access, or use the Service to access another person’s data without their permission;
- attempt to circumvent authentication, access other accounts’ data, or probe the Service’s security other than under a written agreement with us;
- interfere with the Service’s operation, including by automated or excessive use;
- resell or sublicense the Service without our written agreement.
We may suspend access that breaches this section.
5. Your content
You keep all rights in the content you put into the Service and in the calendar data you connect. You grant us only the permission needed to operate the Service for you: to store that content, process it as described in the privacy policy, and act on it as you instruct.
We claim no ownership of your content and do not use it to advertise to you.
6. Third-party services
The Service depends on Google (Gemini models, and Google Calendar if connected), Microsoft (Microsoft Graph, if connected), Supabase and Vercel. Your use of a connected calendar remains subject to that provider’s own terms, and we are not responsible for their acts, outages or changes.
You can disconnect a calendar at any time in Settings, or revoke our access directly with the provider.
7. Artificial intelligence and accuracy
Tess uses large language models. Such systems can misunderstand an instruction, or state something incorrect with apparent confidence.
Check anything that matters before relying on it — particularly a change to a meeting involving other people. You remain responsible for actions taken through the Service, including those carried out on your instruction by the assistant.
8. Availability
We do not promise uninterrupted availability during early access. We may modify, suspend or discontinue any part of the Service, and will give reasonable notice of a material change where we can. Maintenance, third-party outages and voice session limits may all interrupt service.
9. Fees
Where the Service is provided at no charge, we may introduce fees with reasonable notice. Where fees are agreed in writing, those terms apply in addition to these.
10. Disclaimers and liability
Nothing in these terms excludes rights you have under the Australian Consumer Law that cannot lawfully be excluded. Where we are permitted to limit a remedy, our liability is limited to resupplying the Service or paying the cost of having it resupplied.
Otherwise, and to the extent the law allows: the Service is provided “as is”; we exclude implied warranties; and we are not liable for indirect or consequential loss, lost profits, lost business opportunity, or loss or corruption of data. Our total liability for all claims in any twelve-month period is limited to the greater of the fees you paid us in that period and AUD 100.
11. Ending it
You may stop using the Service and ask us to close your account at any time. We may suspend or end access if you breach these terms, or if we discontinue the Service. On termination we delete your data as described in the privacy policy.
12. Changes to these terms
We may update these terms and will revise the date at the top. Material changes will be notified directly. Continuing to use the Service after a change means you accept it.
13. Governing law
These terms are governed by the laws of New South Wales, Australia, and you and we submit to the non-exclusive jurisdiction of its courts.
